1. Agreement to Terms

By accessing or using the PageSpark WP website at pagesparkwp.com, the PageSpark WP API, or the PageSpark WP WordPress plugin (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you") and PageSpark WP, operated by David Repasky Consulting ("we," "us," "our").

2. Service Description

PageSpark WP is an AI-powered WordPress page builder. The Service allows you to generate and edit WordPress page content using artificial intelligence (Anthropic's Claude) through a WordPress plugin connected to our API. The Service includes:

  • A WordPress plugin (free to install) that provides an interface for generating and editing pages
  • A cloud-based API that processes your requests using the Anthropic Claude AI model
  • A web dashboard for managing your account, API key, and token balance
  • A token-based billing system for paying for generated content

3. Account Registration

To use the Service, you must sign in using Google OAuth and create an account. You are responsible for maintaining the security of your account credentials and API key. You must not share your API key with unauthorized third parties.

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement.

You are responsible for all activity that occurs under your account and API key. If you suspect unauthorized use, contact us immediately at support@pagesparkwp.com.

4. Token System & Billing

The Service operates on a prepaid token system. You purchase token bundles, and tokens are consumed when you successfully generate or edit pages. Key terms:

  • Tokens are purchased in bundles via one-time payments processed by Stripe
  • Tokens do not expire — your balance remains in your account indefinitely
  • Tokens are consumed only upon successful completion of a page generation or edit
  • Failed builds or API errors do not consume tokens
  • Token consumption varies based on the complexity of the operation
  • Tokens are non-transferable and may only be used by the purchasing account
  • You may purchase additional bundles at any time to increase your balance

All prices are listed in US dollars (USD). Applicable taxes may be added at checkout depending on your jurisdiction.

5. Refund Policy

Because tokens are a digital product that can be consumed immediately upon purchase, all sales are generally final. However, we may issue refunds at our discretion in the following circumstances:

  • Accidental duplicate purchases made within 24 hours
  • Persistent technical failures that prevent token use (verified by our support team)
  • Unauthorized transactions (subject to verification)

Refund requests must be submitted within 14 days of purchase to support@pagesparkwp.com. Approved refunds will be returned to the original payment method via Stripe. Tokens associated with a refunded purchase will be deducted from your account balance.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:

  • Use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Generate content that infringes on intellectual property rights of third parties
  • Use the Service to create phishing pages, malware distribution sites, or other fraudulent content
  • Attempt to circumvent the token billing system, exploit bugs, or access the Service without authorization
  • Share, resell, or sublicense your API key or access credentials to third parties
  • Use automated tools, bots, or scrapers to make excessive API calls beyond normal usage patterns
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Reverse engineer, decompile, or disassemble the API or any part of the Service
  • Use the Service in any manner that could damage, disable, or impair the Service

We reserve the right to suspend or terminate your account and forfeit remaining tokens if you violate these acceptable use policies.

7. Intellectual Property & Content Ownership

Your Content

You retain ownership of the prompts and content you provide to the Service. The HTML, CSS, and other page content generated by the AI using your prompts is yours to use as you see fit. We claim no ownership over the output generated for your account.

Our Service

The Service itself — including the API, website, WordPress plugin code, system prompts, branding, design, and documentation — is the intellectual property of David Repasky Consulting and is protected by applicable copyright and trademark laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

Third-Party Content

Generated content may incorporate publicly available images, fonts, or libraries (e.g., Bootstrap, Unsplash). You are responsible for ensuring that your use of generated content complies with applicable third-party licenses and terms.

8. AI-Generated Content Disclaimer

The Service uses Anthropic's Claude AI model to generate and edit page content. By using the Service, you acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or unintended output
  • You are solely responsible for reviewing, editing, and approving all generated content before publishing
  • We do not guarantee that generated content will be error-free, unique, or suitable for any particular purpose
  • AI output should not be relied upon as professional, legal, medical, financial, or other expert advice
  • The quality and style of AI-generated content may vary between requests
  • We are not liable for any damages arising from the use of AI-generated content on your website or elsewhere

9. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled or emergency maintenance
  • Third-party service outages (Anthropic API, Stripe, Vercel)
  • Network or infrastructure issues beyond our control
  • Force majeure events

We are not liable for any loss or damage resulting from Service downtime or unavailability. Your unused tokens will remain in your account during any outage.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall PageSpark WP, David Repasky Consulting, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless PageSpark WP and David Repasky Consulting from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) content you generate, publish, or distribute using the Service; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

12. Termination

You may stop using the Service and request account deletion at any time by contacting us at support@pagesparkwp.com.

We may suspend or terminate your account at our sole discretion if you violate these Terms, engage in abusive behavior, or for any other reason with or without notice. Upon termination:

  • Your API key will be deactivated immediately
  • Remaining tokens are forfeited and non-refundable (except in cases of termination without cause, where we may offer a pro-rated refund at our discretion)
  • Your account data will be handled according to our Privacy Policy

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in the State of Texas.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, class arbitration, or other representative proceeding.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify you via email or a prominent notice on the Service.

Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
