Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PageSpark WP website at pagesparkwp.com, the PageSpark WP API, and the PageSpark WP WordPress plugin (collectively, the "Service"), operated by PageSpark WP ("we," "us," or "our"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

PageSpark WP is a software-as-a-service platform that provides AI-powered WordPress page generation. The Service consists of:

  • A cloud-hosted API that accepts page descriptions and returns generated HTML content
  • A WordPress plugin that integrates with the API to allow page generation and editing directly within the WordPress admin dashboard
  • A web dashboard for managing your account, API key, and token balance

The Service uses artificial intelligence models provided by Anthropic (Claude) to generate page content based on your prompts and instructions. Generated pages include HTML markup, text content, and references to images.

2. Account Registration

To use the Service, you must create an account by signing in with Google OAuth. By creating an account, you represent that:

  • You are at least 18 years of age or the age of legal majority in your jurisdiction
  • The information associated with your Google account is accurate
  • You will keep your API key confidential and not share it with unauthorized parties
  • You are responsible for all activity that occurs under your account

You may not create multiple accounts to circumvent usage limits, abuse promotional offers, or for any other deceptive purpose.

3. Tokens, Credits, and Payments

The Service operates on a token-based credit system. Each successful page generation or edit consumes one token, priced at $2.00 USD per token. Key details of the token system:

  • Tokens are purchased as one-time payments through Stripe. There are no subscriptions or recurring charges.
  • Tokens are available in pre-configured bundles or custom quantities at checkout
  • Tokens never expire. Your balance remains in your account indefinitely until used.
  • Failed builds do not consume tokens. You are only charged for successful page generations and edits.
  • Token balances are non-transferable between accounts

All payments are processed securely through Stripe. We do not store your credit card information on our servers. By making a purchase, you agree to Stripe's terms of service in addition to these Terms. All prices are listed in United States Dollars (USD) and you are responsible for any applicable taxes.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Create pages that promote violence, discrimination, or hatred against any individual or group
  • Generate spam, phishing pages, or content designed to deceive or defraud others
  • Produce content that infringes on the intellectual property rights of any third party
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models or proprietary systems
  • Abuse the API through automated scripts designed to overwhelm, degrade, or disrupt the Service
  • Resell, redistribute, or sublicense access to the Service or API without our written consent
  • Use the Service to generate content that exploits minors in any way

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use provisions.

5. Intellectual Property

Your content. You retain full ownership of the content generated through the Service using your prompts and instructions. The HTML, text, and page structures produced by the AI in response to your inputs are yours to use, modify, publish, and distribute as you see fit, subject to applicable law.

Our service. The PageSpark WP platform, API, WordPress plugin, website design, branding, documentation, and all underlying technology remain the exclusive property of PageSpark WP. These Terms do not grant you any right, title, or interest in our intellectual property beyond the limited right to use the Service as described herein.

Third-party content. Generated pages may include references to third-party images, fonts, or libraries. You are responsible for ensuring that your use of any third-party assets referenced in generated content complies with the applicable licenses and terms of those third parties.

6. AI-Generated Content Disclaimer

Content generated by the Service is produced by artificial intelligence and is provided on an "as-is" basis. You acknowledge and agree that:

  • AI-generated content may contain inaccuracies, errors, or content that does not fully match your expectations
  • We do not guarantee the accuracy, completeness, reliability, or suitability of any generated content for any particular purpose
  • You are solely responsible for reviewing, editing, and verifying all generated content before publishing or distributing it
  • We are not liable for any claims, damages, or losses arising from your use or publication of AI-generated content
  • Generated content should not be relied upon as legal, medical, financial, or other professional advice

7. Service Availability

We strive to keep the Service available and functioning reliably, but we do not guarantee uninterrupted or error-free operation. The Service is provided on a best-effort basis. You acknowledge that:

  • The Service may experience downtime for maintenance, updates, or unforeseen technical issues
  • We do not provide a Service Level Agreement (SLA) or uptime guarantee
  • The Service depends on third-party providers, including Anthropic (for AI processing), Stripe (for payments), and cloud hosting infrastructure, any of which may experience outages beyond our control
  • We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAGESPARK WP AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. Refund Policy

Because tokens are a digital product that can be consumed immediately upon purchase, our refund policy is as follows:

  • Used tokens are non-refundable. Once a token has been consumed by a successful page generation or edit, it cannot be refunded.
  • Unused tokens may be eligible for a refund at our sole discretion if requested within 30 days of purchase. Contact us at support@pagesparkwp.com to discuss your situation.
  • Failed builds do not consume tokens and therefore do not require a refund.
  • If you experience a technical issue where a token was consumed but no content was delivered, please contact us at support@pagesparkwp.com and we will investigate and credit your account if appropriate.

10. Termination

You may stop using the Service at any time. Your unused tokens will remain in your account unless you request account deletion.

We may suspend or terminate your account at any time if:

  • You violate these Terms or our acceptable use policy
  • We are required to do so by law or a valid legal process
  • Your use of the Service poses a security risk or may cause harm to other users or the Service itself
  • Your account has been inactive for an extended period (we will attempt to notify you before taking action in this case)

Upon termination for cause due to a violation of these Terms, any remaining token balance may be forfeited. If we terminate your account for reasons other than a violation of these Terms, we will make reasonable efforts to refund any unused tokens.

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Effective date" at the top of this page
  • Notify you via email to the address associated with your Google account, or by posting a prominent notice on the Service

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the changes. If you do not agree with the updated Terms, you should stop using the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless PageSpark WP and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service or any content you generate or publish using the Service
  • Your violation of these Terms
  • Your violation of any applicable law or the rights of any third party

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within thirty (30) days, either party may pursue legal remedies in the state or federal courts located in Texas, and you consent to the exclusive jurisdiction and venue of such courts.

14. Miscellaneous

  • Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PageSpark WP regarding the Service.
  • Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
